dc.description.abstract | El presente trabajo tiene como objetivo analizar los aspectos normativos relacionados con el uso de tecnologías NO PBS y Exclusiones en el Sistema General de Seguridad Social en Salud -SGSSS- en Colombia durante el periodo 2010-2020. Se explican los aspectos jurídicos que afectan directa e indirectamente la prestación de tecnologías no incluidas en el Plan de Beneficios en Salud -NO PBS- y Exclusiones, su forma de aseguramiento y sobre cómo han impactado a lo largo de los años a los diferentes actores del sistema. Para el desarrollo de esta investigación se empleó una metodología con enfoque cualitativo por medio de acciones de carácter interpretativas, deductivas y de depuración de datos para obtener resultados y llegar a conclusiones. Adicionalmente, se hizo revisión de la normatividad de manera cronológica desde la Constitución Política de 1991 y la creación de la Ley 100 de 1993. El desarrollo de la teoría se basó en la revisión de documentos académicos de bases de datos, revistas indexadas, paginas oficiales del gobierno y teniendo en cuenta los criterios de exclusión en la búsqueda de información. Conclusión: La Acción de Tutela y la figura del recobro como fuente de acceso a los servicios no cubiertos con cargo a la Unidad de Pago por Capitación -UPC- como lo NO PBS y las Exclusiones, representan una medida de doble filo, puesto que representan una solución a las negativas de las EAPB para suministrar estas tecnologías, pero a su vez, son un riesgo para la economía del sistema de salud. El uso indebido y desmesurado de parte de las entidades recobrantes han generado un gasto adicional asumido por el Estado y un déficit financiero a los actores del sistema por la demora en los pagos de parte de la Administradora de los Recursos del Sistema General de Seguridad Social en Salud -ADRES-, poniendo en riesgo la operatividad y oportunidad en la prestación de los servicios de salud de la población. | spa |
dc.description.abstract | The present work aims to analyze the regulatory aspects related to the use of NO PBS technologies and Exclusions in the General System of Social Security in Health -SGSSS- in Colombia during the 2010-2020 period. The legal aspects to be directly and indirectly related to the provision of technologies not included in the Health Benefits Plan -NO PBS- and Exclusions are explained, their form of insurance and how they have impacted over the years the different actors of the system. For the development of this research, a methodology with a qualitative approach was used through interpretative, deductive and data-cleaning actions to obtain results and reach conclusions. Additionally, the regulations were reviewed chronologically from Political Constitution the 1991 and the creation of Law 100 of 1993. The development of the theory was based on the review of academic documents from databases, indexed journals, official pages of the government and considering the exclusion criteria in the search for information. Conclusion: The Actions of Tutela and the figure of recovery as a source of access to services not covered by the Capitation Payment Unit -UPC- such as NO PBS and Exclusions, represent a double-edged measure, since they represent a solution to the refusals of the EAPB to supply these technologies, but at the same time, they are a risk for the economy of the health system. The improper and excessive use on the part of the recovering entities have generated an additional expense assumed by the State and a financial deficit for the actors of the system due to the delay in payments by the Administrator of Resources of the General Social Security System in health -ADRES-, putting at risk the operability and opportunity in the provision of health services to the population. | eng |
